Weitz & Luxenberg P.C. is one of the leading plaintiffs' litigation
law firms in America. The firm has played leading roles in national
and local litigations involving defective medicines and medical
devices.  Our law firm is expanding its litigation against Advanced
Bionics related to defective cochlear implants implanted in young
children and adults.

Some of the firm's clients have suffered multiple implant surgeries
due to a defective implant being surgically removed and replaced with a second defective implant that later failed.

If you or your child has been implanted with a defective cochlear
implant, we encourage you to contact Weitz & Luxenberg - we have a Deaf attorney and VP available. To find out more, please click on:

- Dedication

DeafDigest dedicates this edition to Carol Pollington, Wales,
a deaf-blind woman, who was a leader in the Welsh Deaf-Blind
community. She founded a group, Sense's Peer Mentoring
Committee, that reached out to deaf-blind in need of assistance

- What the best newspaper stories are saying about the deaf?

Willie Ross School for the Deaf was started as a
"designer" school for the deaf. The parents, in 1967,
wanted a school for the deaf to be located within
a hearing school setting. This school continues to
attract attention from educators in other school
districts all over the country and the world.

Public health authorities in China have been warning everyone
that inappropriate use of the antibiotic streptomycin have
led to deafness in over a million children. Many Chinese
have a supply of this drug and administer these to the
children without advice of their doctors!

- Very Hot News

Gregg Bowers, who is not deaf, is the CEO at the
Western Pennsylvania School for the Deaf, moving
up the ranks in his 36-year career. When not busy
worrying about WPSD, he spends his free time
worrying about the Edgewood Borough, which is where
the school campus sits on - for he has been elected
as the town councilman!

Said a long time WPSD staffer, who is deaf:

We're glad that he's involved with the town; he
deserves the honor

- Sunday January 2nd

Civil Rights Division
U.S. Department of Justice
P.O. Box 2885
Fairfax, Virginia 22031 - 0885

your complaint is too general

- Monday January 3rd

When deaf people of Travis County in Texas get into trouble
they immediately turn to an attorney that knows ASL. Amber Farrelly Elliott was written up in the newspaper as
the attorney to go to in case of need and assistance.

- Tuesday January 4th

Marybeth Lauderdale, the superintendent at Illinois School for
the Deaf, has been doubling up as the superintendent at the
Illinois School for the Visually Impaired for quite a while.
She needs to make a decision on whether to continue this
dual role or to go into a different direction.

- Wednesday January 5th

the Northern Essex Community College in Massachusetts and the
Gallaudet University Regional Center have jointly won the
contract to teach ASL to families of deaf children.

SILENCE IS WRONG WORD
We are always reading in the newspapers that the
deaf people are silent, or the deaf people are
a silent group, etc?
Are we silent? Of course not! But hearing people
think deaf people are silent because we can't talk
with our voices.
These hearing people are wrong. Many deaf people
can talk. And also, when deaf people use ASL, it
is talking with hands.
Talking with hands is not silence, just that
we often turn off voices while using ASL!

A DIFFERENT "DEAF" CONVENTION
This week there was a posting on a web site, that
said:

Convention of the Future Deaf

This is not a joke. The posting was made by a
musical group.
What are the musicians telling us? That they will
become deaf because of years of loud music.
DeafDigest wonders if our deaf organizations in
future will welcome these ex-hearing ex-musicians?

CSUN's DIFFERENT DEAF FACES
We know that Gallaudet is a stand-alone university. We also know that NTID is just one of nine colleges on the huge Rochester
campus.
But what is CSUN? Proper name is California State University at
Northridge. It previously was known as San Fernando Valley State
College.
CSUN has about 200 deaf students, but this is where confusion
begins.
CSUN has its NCOD (National Center on Deafness). It provides support services to deaf students that take hearing classes.
CSUN also has a Department of Special Education, which is a graduate program in Education of the Deaf.
CSUN also has a Department of Deaf Studies, which offers a BA in various deaf-related majors.
NCOD, Department of Special Education, and Department of Deaf Studies are three separate departments, all which have nothing to do with each other!
The NCOD building is quite a distance away from the building which houses these two other departments. Do NCOD people mingle with people from these two departments on a regular basis? No, basically because of the long walking distances.
And making it even more confusing is the Center for Students with Disabilities. Is it related to NCOD? No, but people do get confused. And these disabled students like CSUN because the campus is flat, with no architectural and surface barriers that block them from getting around.

OLYMPICS AS A COPYRIGHTED WORD?
For years deaf writers were advised never to use the phrase
"Deaf Olympics" in their stories and articles. Instead they
were advised to write like this - "World Games for the Deaf as patterned after the Olympics."
A hearing writer disagreed, saying that the word "Olympics"
is a Greek word and is not copyrighted.
Yes, it is probably moot because World Games for the Deaf
changed to Deaflympics, as "permitted" by the International Olympic Committee.
This is why we have attorneys and the reason these attorneys
get rich!

AN INTERPRETER'S GOOD OLD PRE-RID DAYS
What is a Good Old Pre-RID interpreting days?
A veteran interpreter offered this tale - she and
her client (actually her deaf father) was waiting in the
back of the court room, waiting to be called on the docket.
The judge noticed the interpreter "waving" her hands,
and ordered her to stop it.
The interpreter simply told the judge that she was
interpreting for her father.

THE WEIRDEST DEAF INTERVIEW

On Friday Yahoo ran an article that was titled:

The 25 Weirdest Interview Questions of 2010

DeafDigest editor immediately recalled the weirdest
interview he ever had. As a young man, the editor was
job hunting. He made an appointment for an interview
with a department head of a federal government agency.
The department receptionist, who knew the DeafDigest
editor was deaf, led him to the office of the department head.
Something was wrong! He saw a guide dog sitting on the
floor next to the department head, and knew the interview
was impossible.
The director was blind! It was a tense few minutes
in the office. Both the editor and the blind man knew
communication was impossible. There was no interpreter around.
Suddenly the blind man swung around in his swivel chair
to the typewriter behind him. He typed:

I will contact you after I review your resume. Thank you
for coming

He never contacted the DeafDigest editor. That was
many years ago, years way before we all have heard of
ADA.

WHAT DO INTERPRETERS HATE?

being asked:

can you read lips?

if you have these "hate" or "horror" stories, please

COMMENTS FROM A CART OPERATOR - continuing series

"How does someone become a CART provider?"  I have heard this
question asked many times when people hear what I do for a living.

Because most CART providers use the same skills that court reporters
use, they get their training by attending the same schools that court
reporters attend.  Nowadays there are schools that one can attend in
person and online.

There is no set length of time that someone must attend school
because everyone progresses at a different pace when they are
learning the steno machine and speedbuilding.   Some schools have
two-year programs in place, but some students may take longer to
develop the speed necessary.

Because machine shorthand is a skill that one must learn, the length
of time it takes to acquire it can be affected by someone's motor
skills and how much time is devoted to practicing.

Some of the most talented court reporters have chosen to become CART
providers and have cross-trained after working as court reporters for
a number of years.

THESE MOTHER-IN-LAW PROBLEMS
We are always hearing about these mother-in-law jokes.
These mother-in-law issues take place everywhere, unfortunately.
And it is unfortunate if the mother-in-law is losing her
hearing.
There was a web posting which went like this:

My mother-in-law is very hard of hearing. It has been the cause
of arguments in our family. She misunderstands the family
talk. Or she joins the conversation later after it has started.
And she may think we say bad things "behind her back."

This is the reason why we have a bunch of late-deafened
local and national organizations. These organizations are great
only if the late-deafened mother-in-law turns to them for
assistance and help. It is not so great if the mother-in-law
avoids these organizations for reasons of her own!

DEAF POLITICAL AWARENESS

Q. Why do we have more high ranking deaf legislators in other

A. Because these legislative seats are slotted for the deaf and
the disabled. It is not that way in USA.

let us know.

Hot DeafNews boring, but important!

A lecture "I Am Compelled to Differ - the Philosophical Society in 1883: Bell, Gallaudet and Powell" took place in Washington, DC few days ago.

It is interesting that this Bell & Gallaudet issue is being
revisited in front of a hearing audience in Washington, DC.

.......

The Deaf and the Law:

Are judges fair when applying the law in discrimination
cases? Depends. If a judge is conservative, then he follows the book. If the judge is liberal, he would
use his common sense to decide how the law is interpreted.

Said a deaf attorney:

That's just reality

.......

News of the Week - Looking Back 10 Years Ago:

Jerry Penna, who is deaf, won his battle to get recertified as
emergency medical technician with the Kearsarge Fire Department.
The state of Pennsylvania wouldn't allow him to be certified, but
backed off when legal action was undertaken.
He is no novice EMT, having served in that capacity with the
Evans City, PA fire department before relocating to Kearsarge.
Despite demonstrated experience, the state objected. Good thing
they relented.

.......

News of the Week - Looking Back 5 Years Ago:

Is it possible for a team of scientists to pick up
a bag of bones for intense scrutiny and then to declare
that the once-living being was deaf?
This is what Otto Gleich and his team of scientists
at Germany's University of Regensburg is saying that the
Tyrannosaurus rex dinosaur is deaf!
Is it credible - to go back millions, or even
billions of years ago and declare that a certain animal
was deaf?

.......

Deaf Apocalypse of the Week:

We have a CDI, which stands for Certified Deaf Interpreter.

Yet most of them are "idle" and are rarely able to use
their interpreting skills.

.....

A Lipreading Problem: What did that person say?

Said a DeafDigest subscriber:

I was showing off a new pair of shoes to my colleague and she asked me if they are sweating?

Me...(?) No, they are not sweating and they are comfortable.

She...No, no (she was laughing), I didn't ask if they are sweating. I was asking if they are suede (which they
are)
