Weitz & Luxenberg P.C., founded in 1986, is one of the leading
plaintiffs' litigation law firms in America.

The firm has played leading roles in national and local litigations
involving defective medicines and medical devices, and general
negligence, among others.

Our law firm is expanding its litigation against the California-based
Advanced Bionics Corporation, related to defective cochlear implants
implanted in young children and adults.

Some of the firm's clients have suffered multiple implant surgeries
due to a defective implant being surgically removed and replaced
with a second defective implant that later failed.

If you or your child has been implanted with a defective cochlear

- Dedication

DeafDigest dedicates this edition to John Fedio, of Southeastern
Pennsylvania, who departed us. In the early days of the TTY
network, he was one of these dedicated TDI agents that
served the TTY needs of the deaf in his community. The nationwide
network of TDI agents have disappeared for good, because of the
portable TTY devices.

Deaf Miscellaneous stuff:

Election officials in Florida's Broward County (which
has a large population of deaf residents) have been
dragging their feet on making their voting machines
deaf-friendly. They were mandated to finish the task
by 2012 - but are asking for time extension! Reason
is money, money and money needed to make the changes.

INTERPRETERS AT DOCTOR'S OFFICES
More and more doctors agree that interpreters are
important with deaf patients during medical
appointments.
The big issue is - who pays for interpreters?
Doctors do not want to pay for interpreters. Insurance
companies do not want to pay for interpreters.
This is the big issue today.

LOOKING FOR A JOB
When deaf people look for a job, sometimes results are
funny, and even sad.
A Coda boss may refuse to hire the deaf. Or a boss, that
knows sign language, may also refuse to hire the deaf.
Yet, there are bosses that are not Coda or ASL signers
but are happy to hire the deaf.
   Why? Good question!

MARK WOOD, THE DEAF MOVIE DIRECTOR
Mark Wood, a 1989 graduate of California School for
the Deaf at Fremont, is a movie director with four
deaf films to his credit.
He was interviewed and written up in the a recent
edition of the school publication.
The points he stressed was that his four films
cost nearly half million dollars to produce. And that
he is almost breaking even. And to fund these films
he had to use the equity from his house.
His goal is to make it in Hollywood.

A QUESTION ABOUT VIDEO RELAY THAT YOU WERE AFRAID TO ASK

Q. The money that FCC oversees is not just for video relay.
What others would the money be used for?

A. captioned telephone, speech to speech, voice carry over.
Keep in mind many people are late-deafened, as opposed to us,
born-deaf.

REASON FOR DEAFPHOBIA?
From time to time, DeafDigest mentions
deafphobia (a word that does not exist in our
dictionary). It defines a hearing person deathly
afraid of getting in contact with the deaf.
Why are some hearing people afflicted with
deafphobia?
According to a science magazine, it may be
something to do with emotions in the visual
system that "warn" him of getting involved
in an unwanted issue?
DeafDigest editor does not pretend to be
a psychologist, though.

WHAT DO INTERPRETERS HATE?

said a video relay interpreter:

Not being able to complete a relay call. Western Union,
Wachovia Bank, some Bank of America branches will not
accept relay calls. They think interpreters, being
third party, may not share information with the deaf
person.

if you have these "hate" or "horror" stories, please
mailto:barry@deafdigest.com

COMMENTS FROM A CART OPERATOR - continuing series

What should we do if we have a complaint about closed captioning?

Here is information from the FCC's Web site about what steps you
should take:

The FCC's closed captioning rules require consumers to first complain
in writing to their TV distributor, such as your cable or satellite
TV service, or to the TV station if you receive television via an
over-the-air antenna, before contacting the FCC.

Closed captioning complaints should be very specific. Include the
following information in your written complaint to the TV
distributor:

 * Your name, full address, daytime phone/TTY number, and any other
contact information, such as an e-mail address if available, so
they may contact you if any clarifications are needed

 * The name of the television program(s) you experienced closed
    captioning problems with

 * The name and number of the channel(s) the show was on (For
example- Channel 3, The Art Channel)

 * The date(s) and time(s) you experienced the problems with closed
    captioning

 * A description of the closed captioning problem. For instance, "no
closed captioning during entire show," "closed captioning
disappeared 5 minutes after the program began," "closed
captioning was garbled throughout the show," "the words were
unintelligible such as 'axuy' and '&8777**edz'" or "the closed
captioning was not in sync with the audio."

Hot DeafNews boring, but important!

was that one of the bank employees knew sign

News of the Week - Looking Back 10 Years Ago:

It is OK to have bad Hearing English, says Kirk
Hazen, a West Virginia University linguistics professor.
Hazen, who is not deaf, claims support from colleagues
at George Washington University!
If it is OK to have bad Hearing English then it is
OK to have bad Deaf English, sez DEAFDIGEST!
Said Daniel Moshenberg, a GWU English professor, who
again is not deaf, "To start judging a people's
intelligence by the way they speak is incorrect."
A certain deaf leader, no longer alive, held this
lifetime misconception that Bad Deaf English was
equivalent to low intelligence level.

If University of California at San Diego has its way,

(DeafDigest editor is not sure if the program succeeded

Deaf Apocalypse of the Week:

Year 2010 becoming a crisis among our interpreters?
It has nothing to do with interpreting in person
or video-interpreting or even of these confusing
interpreting standards in many states.

It has a lot to do with the year 2010 itself.
How do interpreters sign 2010 - as if it is
twenty-ten or two thousand-ten!

Makes no difference one way or other to DeafDigest,
though.
