Weitz & Luxenberg P.C. is one of the leading plaintiffs' litigation
law firms in America. The firm has played leading roles in national
and local litigations involving defective medicines and medical
devices. Our law firm is expanding its litigation against Advanced
Bionics related to defective cochlear implants implanted in young
children and adults.

Some of the firm's clients have suffered multiple implant surgeries
due to a defective implant being surgically removed and replaced with a
second defective implant that later failed.

If you or your child has been implanted with a defective cochlear
implant, we encourage you to contact Weitz & Luxenberg - we have a Deaf

Dedication

DeafDigest wishes to dedicate this edition to James
Grady Berry who departed us.

He served Arkansas School for the Deaf in various capacities
for 25 years until he retired. Said a friend:

Grady was a positive influence on many students

....

DeafDigest also wishes to dedicate this edition to
Dawn Boozer-Carter, an 8th grader at Indiana
School for the Deaf, who departed us in the most
tragic circumstances ever. As an aspiring high
school basketball player, she was helping out with
her team's fund raising event, a car wash. A
deranged driver deliberately rammed the car at
her. After several weeks at the hospital she
departed us. The driver is in police custody for
a murder trial.

How a deaf woman from a deaf family learns language?
http://deafdigest.com/louisestern-2/

Why would a deaf candidate get financial backing in Scotland?
http://deafdigest.com/jeffmcwhinney/

- Very Hot News

Famous comedian Joan Rivers made a joke about Helen Keller.
The audience roared with laughter; one person did not laugh.
He shouted at her saying that it was not funny because his
son was deaf.

Sad to say, in the world of comedy, one person's joke is
another person's insult.

- Sunday June 6th

The buzz on the Hill is that the H.R. 3101
(21st Century Communications and Video Accessibility Act)
will meet congressional approval.

- Monday June 7th

Invisible hearing aids (not CI) better than visible
hearing aids? A posting on a hearing-aid related web site
gave strong arguments in favor of such invisible hearing
aids

- Tuesday June 8th

Apple is saying that we, the deaf, can use the iPhone 4 to
communicate with each other via the FaceTime chat feature.
This device will be ready for the marketplace on June 24th.

- Wednesday June 9th

Faced with closing, Detroit Day School for the Deaf, has
been given a new lease on life. It was the parents of deaf
children that succeeded in staving off the city's efforts
to close the school for good.

USING A WRONG INTERPRETER
One hearing actor in Ireland was invited to a deaf
event. The host told him they will have an interpreter for
him.
The actor and the interpreter showed up at the deaf event.
But the deaf event was a flop. Why?
Because the interpreter only knew British Sign Language
while the deaf people only knew Irish Sign Language.
The host did not realize about it until it was too late!

BE CAREFUL IN PUBLIC SPEAKING
All public speakers must be careful with what they
say. Helen Thomas, not deaf, had to resign from her
job as White House reporter. She said a wrong thing
that made many people angry at her.
Can't happen to the Deaf Community? Wrong! DeafDigest
editor remembers two incidents:

- a well known deaf oralist said that deaf people with
ASL have minds the same as monkeys. He quickly became
unpopular and lost his job as CEO of a deaf
national organization

- Jane Basset Spilman, not deaf, was chair of Gallaudet
board of trustees during the Deaf President Now protest.
She said "Deaf people are not ready to function in a hearing world." She
had to resign from the board of
trustees

A DEAF-OWNED, DEAF-RUN BANK
A couple of years ago, James W. Meisser, who is deaf,
and pretty much experienced in the banking field, wanted
to open up a deaf-owned, a deaf-run bank.
At first he was not successful. Because of economy
free fall, he had a hard time attracting capital.
Not giving up, he tried a different approach - purchasing
an existing bank. And he succeeded.
He is now the president/CEO of the Hiawatha National Bank
in Wisconsin. This bank has branches in several small Wisconsin towns.

OUR NATIONAL ORGANIZATIONS
For the past several months DeafDigest has been
briefly profiling one national organization each
week.
It is DeafDigest's way of thanking our national
organizations for their contributions to our
Deaf Culture.
And it is always satisfying when some of these
organizations get requests for information as
a result of these weekly profiles.

A BIG BASEBALL GAME NOT CAPTIONED
Baseball fans across the USA was buzzing all about
Stephen Strasburg's sensational major league debut.
A deaf fan was watching the game on TV. This game
was not captioned.
DeafDigest editor was also watching that game and
yes, it was captioned.
Why was the game captioned on one TV set and not
captioned on the other.
DeafDigest editor subscribes to an established
cable provider, which provides captions. The
deaf fan subscribed to a telephone company's
bundled communications service. And while most of
his TV programs were captioned, that particular
ball game wasn't.
The deaf fan is not too happy about it and
plans to bring up this issue with the telephone
provider.

TEACHING IN A RURAL AREA
A teacher of the deaf in a rural area raised
an interesting issue.
She graduated from an established deaf education
program at a big city university. She then
accepted a teaching position in a small town.
But much to her dismay she discovered that it
was difficult to keep up with new material
and resources in the field.
These small town libraries and educational
programs do not have such updated resources.
It was only through the internet that she
was able to obtain what she was seeking.

THE FORT WORTH DEAF PIZZA-COPS SYNDROME
The Domino's Pizza has been famous for its
30-minute, money back delivery promise.
And the police department in Fort Worth,
Texas, has copied this famous promise.
What is this all about? The police department
has pledged a 30-minute wait for an interpreter
to show up in case a deaf person is arrested
and in custody.
This 30-minute wait is much better than waiting
3-4 hours for an interpreter to show up, thus
fraying everyone's tempers.
There is a caveat. What if the interpreter
does not show up? There have been tales of
a deaf person arrested on Saturday nights,
and police departments scrambling around
to find an interpreter.
In one case, the director of an interpreting
agency was routed out of bed a 2 AM because
the interpreters that were supposed to be on
call that night, sort of sneaked away from work.
The director raised a big stink when
confronting with these interpreters that played
hooky.

WHAT DO INTERPRETERS HATE?

being asked:

could your deaf client drive a car?

if you have these "hate" or "horror" stories, please
mailto:barry@deafdigest.com

COMMENTS FROM A CART OPERATOR - continuing series

Another type of realtime captioning error that people may not
understand is when something comes up as two words when it
should be one word or vice versa.

They may think the captioner or CART provider does not know
that certain words are compound words.

What many people do not understand is that there is no space bar
on the steno keyboard. A captioner or CART provider will write
one stroke at a time. That stroke may be a word or phrase on its
own, or it may have to be combined with the stroke before it or
after it to make a word.

Examples of words that could create problems are
off, on, over, back, through, and out.

Even though a captioner writes phonetically, in order to avoid
word boundary problems, the captioner must have different ways
to write a word when it stands on its own as opposed to when it
is used as a prefix or suffix.

If a captioner put the word "overtime" in his or her dictionary,
it could present a problem when sentences like these come up:

- The fee started at $5 and increased overtime.

This should read:

- The fee started at $5 and increased over time.

- He read a newspaper at the airport during his lay overtime.

This should read:

- He read a newspaper at the airport during his layover time.

Hot DeafNews boring, but important!

Karen Rossi is the new Executive Director of the
Tucker-Maxon School in Oregon. She served as
interim executive director before being
awarded this permanent position.

The school is oral; does not use ASL.

....

The Deaf and the Law

- location
Alabama

- case
a deaf employee hurt his back at his place of employment
and requested workman's compensation.

- result
the lower courts ruled in favor of the deaf employee;
the company appealed; the appeals court partly ruled
in favor of the deaf employee, and in favor of the
company - and remanded the case back to the lower courts.

- comment
inadequate communications at the place of employment
led to a series of misunderstandings on part of the
deaf employee and the company supervisors.

.....

The Captioning Blunder of the Week:

he missed 30 kays (days) of school

...

News of the Week - Looking Back 10 Years Ago:

Ron Stern is the new superintendent at the
New Mexico School for the Deaf. He will move
to Santa Fe from his current position at
California School for the Deaf at Fremont.

(editor's note: superintendents come and go;
Ron is still at the helm at New Mexico School
for the Deaf!)

.....

News of the Week - Looking Back 5 Years Ago:

Next time you are raising a glass of wine to toast
a deaf friend, do it with Deaf Wine.
Deaf Wine? Not talking about wine produced by
Deaf Vintners. But the Deaf Wine itself.
The bottle - 1997 Ballet of Angels, by Sharpe Hill
Vineyard, Pomfret, Connecticut - has a painting "Francis
O. Watts with Bird" on the label. The 1805 painting was
done by deaf artist John Brewster (1766-1854).

...

Deaf Apocalypse of the Week:

There was a newspaper story that said the CI helps
younger deaf people more than it helps the senior
citizens.

Why is this a surprise? Senior citizens, because of
age, lose hearing that the CI cannot help recoup.

.....

A Lipreading Problem: What did that person say?

Said a DeafDigest subscriber:

I went downstairs looking for the accounting person and was told
that she's at West Point

I was walking back upstairs and I passed by the front desk and saw
the person I was looking for and then I realized that I was told
"switchboard" not the "West Point" of Mississippi

poorly for years as Gallaudet professor, but is lionized
for recognizing ASL as a legitimate language.
